Trusts, Wills and Other Safety Nets

The first, and most important, step in planning for your future is to put your Safety Nets in place. We focus on those Safety Nets offered in our laws to protect your assets and even independence in the coming years -- legal instruments such as Revocable Living Trusts, Irrevocable Trusts, Special Needs Trusts, Wills, Articulated Wills and Testamentary Trusts, Powers of Attorney, Health Directives, and when they are needed, conservatorships and guardianships.

We can help with a wide range of these legal instruments, including the following:

  • If you simply want to save your family the problems and expense of probate, we can help you set up a Living Trust and articulated will, either for you alone, for you and your Spouse, or for your entire family.
  • If your concern is Inheritance or Property taxes, we can help you set up an AB Trust, a Generation Skipping Trust, or another special trust suited to your needs.
  • If you plan to make gifts to young children, we can help you set up guardianships to protect their assets until they are old enough to make good decisions on their own.
  • If you are concerned about the management abilities of an adult child or other loved one, we can help you set up a Spendthrift Trust or Sprinkling Trust to protect their assets.
  • If you face special frailties or family relationships, we can help you avoid the risk of being placed in a conservatorship, by setting up a Trust, Power of Attorney and Health Care Directive, ensuring that when you are unable to make important decisions, they will be made by someone you trust.
  • If a conservatorship is truly needed for a loved one, we can help you set one up.
  • If you are concerned for the future of someone disabled, we can help with Special Needs Trusts to protect Medi-Cal eligibility, and -- when it is needed -- we can help you set up a conservatorship or legal guardianship.
  • If you are concerned about qualifying for Medi-Cal, on the chance that you might have to enter a nursing home, we can advise you on your options. (Most often -- despite what financial "experts" may tell you in a seminar or radio pitch -- it doesn't make sense to convert or divest your assets now, on the chance that you may need long-term care sometime in the future).
  • If you are concerned about the welfare of your companion animals, we can help you set up an Honorary Trust for their benefit.
